Legal framework for deposit protection

The basic legislation that regulates the position, functions and operations of the Deposit Protection Fund is the Act of the National Council of the Slovak Republic no. 118/1996 Coll., of 20 March 1996 on the protection of deposits and amending certain laws, which entered into force on 1 July 1996. The Deposit Protection Act transposed Directive 2014/49/EU of the European Parliament and of the Council of 16 April 2014 on Deposit Guarantee Schemes (recast) into national legislation (OJ EU L 173, 12.6.2014). At the same time, the related provisions of Directive 2014/59/EU of the European Parliament and of the Council of 15 May 2014 establishing a framework for the recovery and resolution of credit institutions and investment firms and amending Council Directive 82/891/EEC and Directive of the European Parliament and of the Council 2001/24/EC, 2002/47/EC, 2004/25/EC, 2005/56/EC, 2007/36/EC, 2011/35/EU, 2012/30/EU and 2013/36/EU and Regulations of the European Parliament and of the Council 1093/2010 and (EU) No. 648/2012 (OJ EU L 173, 12.6.2014) were transposed. Some activities, tasks and position of the Deposit Protection Fund are regulated by internal legislation, such as the DPF Articles of Association, DPF rules of procedure, DPF staff regulations, DPF staff remuneration rules, accounting and reporting principles and other regulations approved by the Deposit Protection Fund Council or the Deposit Protection Fund Presidium.
